NORTHLAND MX PRACTICE TRACKS

WAIVER OF LIABILITY, ASSUMPTION OF RISK & INDEMNITY AGREEMENT (Iowa Code chapter 673B)

 

The undersigned, by signing this agreement, accepts full responsibility and liability for himself/herself while utilizing the Northland MX Practice Facility (the “Facility”). This includes the tracks as well as the grounds around and including the tracks, parking areas, spectator areas, and the office/restroom facility. This waiver is valid for one season (the calendar year in which it is signed).Acknowledgment of Inherent Risks
The undersigned acknowledges that the Facility is designed for practicing motocross and that motocross riding is a sport with inherent risks of serious injury or death. These inherent risks include, but are not limited to: collisions with other riders or objects, falls, jumps, track conditions, surface variations, equipment failure, and operator error. Under Iowa Code chapter 673B, a facility operator is not liable for injury or death resulting from the inherent risks of motocross activities.

Release and Waiver

The undersigned hereby RELEASES, WAIVES, DISCHARGES and COVENANTS NOT TO SUE Northland MX, its owners, operators, sponsors, employees, agents, heirs and assigns (collectively the “Releasees”) from any and all liability for injury, death, or property damage arising out of or related to the use of the Facility, whether caused by the ordinary negligence of the Releasees or otherwise.Indemnification
The undersigned agrees to INDEMNIFY AND HOLD HARMLESS the Releasees from any loss, liability, damage, or cost (including attorney fees) that may arise from the undersigned’s use of the Facility or from any claim brought by or on behalf of the undersigned.

Assumption of Risk & Inspection

The undersigned has inspected the Facility, is aware of the course layout, and has determined of his/her own free will that he/she has the skills necessary to ride on the Facility. The undersigned acknowledges that any hazards present are known to him/her and to all persons under his/her care or guidance.

For Minors

If the participant is under 18 years of age, the undersigned parent or legal guardian acknowledges the inherent risks of motocross activities, agrees to all terms of this waiver on behalf of the minor, and agrees to indemnify and hold Northland MX and its owners, operators, and employees harmless from any claims, demands, or expenses arising from the minor’s use of the Facility.

Additional Terms

  • This is the primary waiver document for the current season and must be resigned annually.
  • A signature sheet must be signed each day of riding acknowledging continued agreement to this waiver.
  • This document will be kept on file for the entire season.
  • This waiver does not release liability for willful or wanton misconduct or intentional acts.
